Terms and Conditions

By placing an order with Lamp Express USA, Inc. you are bound and fully agree to our terms and conditions.

General Information
LE is used in this document to refer to Lamp Express USA, Inc.
All products are sold according to our Terms and Conditions. By placing an order with LE your are bound to our Terms and Conditions, no exceptions.
LE is a Authorized Importer/Distributor for THEIMER Products in the United States and Canada. Any person or company selling, distributing, wholesaling, vending, marketing, displaying, advertising or exhibiting any THEIMER or BLUETEC product in the U.S. or Canada (or attempting any of the foregoing) without the expressed written permission of LE is unauthorized. Any THEIMER or BLUETEC product purchased from any unauthorized source is not covered by applicable warranties.
All products sold by Lamp Express are replacement products unless otherwise specified.


Prices and specifications are subject to change without notice. Occasionally LE may publish special sales prices on our web sites. These prices are only available to end users when ordering on-line and are not subject to dealer discounts.
LE offers Level1 quantity discounts to all of its customers. These discounts are made public on our web site. Level2 discounts are available to customer with annual purchasing volumes of $6,000.00 or more. If the $6,000.00 sales volume is not reached in any given calendar year, the customer will receive standard Level1 discounts in the following calendar year.
Payment Terms
End user: Terms of payment are; Pre-Payment, Credit Card or Cash on Delivery (COD). COD orders are subject to a $10.00 surcharge. After credit approval net 30 days.
Resellers: The first five orders need to pre-paid. Thereafter terms can be established upon credit approval. Terms of payment are 1% 10 days, net 30 days.
All customers:
LE requires all customers with payment terms to provide a valid credit card that stays on file with us. The credit card will be charged no later than five (5) days after the due date of any unpaid balance. In case the credit card cannot be processed for any reason, late fees will be calculated and charged together with a processing fee of $20.00 to the customer.
The current APR is 24%.
Customer with payment terms will be reverted to 'Pre-Payment' status when more than three (3) past due conditions occur in any given calendar year.
Payments not received after 60 days will automatically forwarded to a collection agency for further processing. All subsequent charges are the responsibility of the customer.

Late Payments

Payments not received within terms, will trigger a late payment invoice. This invoice will include the daily interest since past due, based on the current APR plus a $20.00 administrative recovery fee. Another late payment invoice will be issued every seven (7) days until the balance and all late payment invoices are paid in full.

Special order items
Parts and equipment that are deemed 'Special Order' require a 100% deposit when placing the order. All special orders item sales are final.

Foreign orders
We do not provide payment terms to international customers. Orders placed from outside the United States of America need to be paid in full, by credit card, PayPal or wire transfer when placing the order.

Account Closure
LE reserves the right to close a customers account if the customers fails to pay repeatedly within the defined payments terms or if a blanket purchase order is not closed within the agreed time period.
At the sole discretion of LE a termination fee of $400.00 is due in those cases.

BLUETEC Information
BLUETEC is a trade name of LE.
Theimer Parts Warranty Information
All replacement parts are warranted for 90 days, with the following exceptions: All printed circuit boards, transformers and chokes carry a six month warranty (lamp change records have to be submitted at time of warranty request). Excluded are special order items.
Hamamatsu Information
We are the authorized North American Distributor for Hamamatsu Japan.
Please take a note Hamamatsu Corporation / Hamamatsu Photonics KK, manufactures products that are subject to US export law. Hamamatsu lamps are controlled by the U.S. Government and authorized for export only to the country of ultimate destination for use by the ultimate consignee or end-user.

Before we can accept your order, you must comply to the conditions outlined below in writting.Hamamatsu requires you to reveal the name and address of the end users details before releasing the lamps when being purchased by a third party for distribution. This information is confidential and will not be used to pursue, market or direct sell to your customers by Hamamatsu or Lamp Express.

Lamps may not be resold, transferred, or otherwise disposed of, to any other country or to any person other than the authorized ultimate consignee or end-user(s), either in their original form or after being incorporated into other items, without first obtaining approval from the U.S. Government or as otherwise authorized by U.S. law and regulations.

The lamps must not be used for any military application.

Theimer Parts Warranty Information 
All replacement parts are warranted for 90 days, with the following exceptions: All printed circuit boards, transformers and chokes carry a six month warranty (lamp change records have to be submitted at time of warranty request). Excluded are special order items.
Theimer Equipment Warranty Information
Theimer equipment is warranted under Theimer’s terms and conditions. LE warrants Theimer equipment to the original purchaser against defects in material or workmanship for a period of six month from the date of shipment. Under this warranty LE’s obligation is limited to replacing or repairing the defective equipment, at its option. All warranty service is handled through the dealer from whom the equipment was originally purchased. Labor and transportation charges for warranty service and installation costs are not covered, and may be charged at the option of the dealer. LE will not cover equipment under warranty when the failure was caused by improper installation and/or operation.
Warranty of Theimer equipment which becomes part of another machine, i.e. integration of a Theimer exposure system into a customer designed system, is not warranted by LE or Theimer. LE or Theimer will not provide field support for these units, however LE will provide technical phone & eMail support for up to six month after delivery of the equipment.
Parts and components failing within a period of 90 days from the date of shipment, will be replaced free of charge as long as the failure was not caused by improper handling, installation and operation of the equipment. Labor, shipping and transportation charges for warranty service and installation costs are not covered under this warranty.
Any defective item replaced under warranty is considered the property of, and must be returned to LE if requested. Warranty is void when other than BLUETEC lamps are used in THEIMER equipment. Excluded are special order items.
General warranty Information
Products sold by LE are warranted under the original manufacturers terms and conditions. LE will not cover equipment or parts under warranty when the failure was caused by improper installation. Any defective item replaced under warranty is considered the property of, and must be returned to LE if requested. Excluded are special order items.
LE will replace products free of charge if they fail during the manufacturers warranty period. Shipping cost are NOT covered by this warranty and are the responsibility of the customer. Product Breakage during Installation
Product breakage during installation or return transit to Lamp Express is not covered under warranty. No refunds, credits or replacements !

Product Breakage during shipment
Examine the contents of the shipping box at once for damage. If box shows sign of damage, make a notation on the packing list and request inspection by the freight company. (FedEx, UPS etc.)
If damage cannot be detected until package is opened, call the freight company for inspection and get a concealed bad order report.
Claims for damage, visible or concelead, must first be filed by you. 
All shipments are at the customer's risk for breakage. LE is not liable for any damage that occurs during transit of a shipment. Shipping damage including glass breakage is NOT covered by the manufacturers warranty. Consequently LE is not responsible for any and all product damage that occurs during shipping and will NOT replace any damaged product under warranty. We cannot assume responisbility for loss or breakage in transit.

Shipping insurance & Coverage
Shipping insurance is available on request by the customer. Insurance cost is a percentage of the product value. Please contact us for details.
The optional shipping insurance covers all products that arrive damaged during a single shipment. Lamp Express will replace all damaged products free of charge to the customer. Any broken item replaced under this insurance is considered the property of, and must be returned to LE if requested at the customers expense.
Shipping costs and the optional shipping insurance for replaced items are NOT covered.
Shipping damage not reported after three (3) days of reception is not covered.
The customer is responsible for all shipping charges and may opt for insurance coverage again.

Special Order Items
LE can supply certain products that are not part of our normal product range on customer request. Special order items require payment in advance and are not covered under warranty, other than the manufacturers warranty if available. LE provides no technical support for special order items and is not responsible if the special order items do not perform as expected. Special order items are not returnable. All sales are final.
Technical Support
Free technical support and trouble shooting is provided for all equipment sold by LE for a period of one year. LE is not supporting Theimer equipment sold by other vendors or from the Theimer factory directly. Technical support for equipment older than five years is available, at an hourly rate charge of $90.00

LE, at its sole discretion, will either replace defective items under warranty or issue a credit note to the customers account. LE does not issue checks or cash refunds for warranty compensation.

Returned Items
Product must be returned with prior approval and issuance of a return material authorization number (RMA#). To obtain an RMA# call 1-888-539-8847. Issuance of a RMA# does not acknowledge a product defect or authorize credit to be taken. Product determined to be defective by the applicable manufacturer shall either be replaced or credit will be issued at the discretion of LE.Product returned as defective, and is not, will be returned to the customer or discarded. Product returns are subject to a 25% restocking fee, provided that LE agrees to take back the merchandise. Special orders may not be returned. No returns will be accepted after 30 days.

Cancelled Orders
Orders can be cancelled as long as the item has not shipped. Customer must accept items that are enroute and assumes the responsibility for all charges incurred. This includes freight- and applicable duty and tax charges including all charges for the return shipping. Returned Items regulations apply.
Orders for Special Order Items cannot be cancelled !
Minimum Order
The minimum order value for reseller is $100.00
There is no minimum order value for end users.

Blanket Purchase Orders
Customers can place blanket orders with us. LE will make every effort to stock the requested product(s) for immediate delivery and will cover all inventory expenses to the benefit of the customer.

Orders placed by 4pm EST, ship the same day when in stock. Once your product has been shipped we will send your tracking information to the e-mail address provided so you can be advised of the delivery date. If there is a lead time for the product and it is not available the day you place your order we will contact you.
All shipping charges are based upon weight and/or dimensional size of shipment.

Duty and Tax
LE is not responsible for import duties, taxes such as VAT and other levies.
Please consult your local customs office for all relevant charges before you place your order.
Product and shipping charges that are calculated by our web server on check-out may not be accurate. Should we discover any errors while processing your order, we will contact you before your credit card will be charged. Shipping charges for international orders are determined after the order is placed, due to special packaging requirements. We will contact you with the actual shipping charges, before your credit card will be charged.

The LE websites have been prepared solely for the purpose of providing information about LE and the products and services we offers. The websites are compiled in good faith by LE. However, no representation is made as to the completeness or accuracy of the information they contain.
In particular, you should be aware that this information may be incomplete or may contain errors.
The contents of the web site can become out-of-date and LE makes no commitment, and disclaims any duty, to update any of those pages.
LE reserves the right to add, modify or delete any information at this website at any time.
The information on the LE web site and any references to products or services are provided 'as is' without any warranty or implied term of any kind.

LE shall not be liable for any injury, loss, or damage, direct or consequential, arising from the use or inability to use the equipment. It is the purchasers responsibility to determine the suitability of the equipment for the intended use and the purchaser assumes all risks and liabilities.

Limitation of Liability
(a) Neither LE nor its suppliers shall be liable to you or any third party for any indirect, special, incidental, punitive, cover or consequential damages (including, but not limited to, damages for the inability to use equipment or access data, loss of business, loss of profits, business interruption, or the like), arising out of the use of, or inability to use, the software and or hardware and based on any theory of liability including breach of contract, breach of warranty, tort, (including, but not limited to, negligence), product liability or otherwise, even if LE or its representatives have been advised of the possibility of such damages and even if a remedy seth forth herein is found to have failed of its essential purpose.
(b) (USA only) Some states do not allow the limitation or exclusion of liability for incidental of consequential damages, so the above limitation or exclusion may not apply to you and you may also have other legal rights that vary from that to state.
(c) LE’s total liability yo you for actual damages for any cause whatsoever will be limited to the greater of one Dollar ($1) or the amount paid by you for the software or hardware that caused the damage.
(d) The foregoing limitations on liability are intended to apply to the warranties and disclaimers above and all other aspects of this End-User license agreement.
(Outside of the USA) Consumer End User Only
The limitation or exclusions of warranties, remedies or liability contained in this End-User license agreement shall apply to you only to the extent such limitations or exclusions are permitted under the law of the jurisdiction where you are located.
LE assumes no liability for parts, equipment and parts thereof which are used by customers to be assembled, integrated or being used in any form in their own machinery or setup. This includes conversion kits, assemblies, kits, components, power supplies and light sources.
